Club Marena: Rules, Regulations, and Code of Conduct (2025)

Welcome to Club Marena, the premier condominium development in Northern Baja. The Homeowners Association (HOA) Management and VMAC Administration remind everyone that Club Marena is not a hotel or resort. Every member and guest is expected to respect the property and the space of others, and to adhere to all rules, regulations, and codes of conduct outlined below.

Definitions

  • Homeowner – An individual who owns a Club Marena condominium and holds all ownership privileges. Owners may rent out their property or permit its use as allowed by law, provided they remain current on all condominium dues, assessments, fines, and other payments owed to the administration.
  • Resident (Long-Term) Renter – An individual or individuals renting a condominium for four months or more as their primary residence. Resident Renters enjoy the same privileges as Homeowners regarding facility use.
  • Authorized User – An immediate family member or domestic partner of a Homeowner, designated by the Homeowner and registered with Security, who has independent access to Club Marena. Authorized Family Members (including spouses, domestic partners, parents, and adult children of the Homeowner) may utilize the common areas and amenities without being accompanied by the Homeowner or Resident Renter, once they are approved and recorded with Security. The Homeowner must arrange for the registration of an Authorized Family Member with Security in advance by providing the individual's name and their relationship. Homeowners are always responsible for the conduct and rule compliance of their Authorized Family Members.
  • Authorized Guest – A person or persons invited by a Homeowner or Resident Renter to visit Club Marena on a short-term basis. Authorized Guests must obtain prior permission from the sponsoring Homeowner, Authorized Family Member, or Resident Renter and register with Security before each visit, providing their names, ages (if under 16), relationship to the host, and visit dates. If an Authorized Guest is an immediate family member or a frequent visitor, they may be added to Security’s Frequent Guest list and will not need to register for each visit. Only immediate family members designated as Authorized Users may use the facilities independently. All other Authorized Guests must be accompanied by the Homeowner or Resident Renter when accessing the common areas or amenities of Club Marena.
  • Vacation (Short-Term) Renter – An individual or group renting a unit for less than four months. Vacation Renters have limited privileges as outlined in these rules. To enter the development, all Vacation Renters must present a completed Vacation Rental Agreement to Security at the entrance gate. Vacation Renters cannot authorize additional guest entry into the development.
  • Unaccompanied Guest Stays (Extended Stay) – If a guest who is not an Authorized User or registered immediate family member stays in a unit without the Homeowner or Resident Renter present (for instance, a friend using the unit while the owner is away), the owner must complete the Short-Term Renter registration forms before the guest’s arrival (even if no rent is charged). Such an unaccompanied guest is subject to the same rules and regulations as a Vacation Renter. Guests without the owner present who have not been designated as Authorized Users and lack the proper pre-authorization forms on file will be denied access to Club Marena.

Applicability of Rules

These rules apply to all individuals who enter Club Marena or access the ocean through Club Marena. Use of the facilities is restricted to Homeowners, Resident (Long-Term) Renters, their designated Authorized Users (family members or partners), their Authorized Guests, and registered Vacation Renters. With the exception of Authorized Users as defined above, guests must be accompanied by a Homeowner or Resident Renter when utilizing the amenities. Homeowners and Renters are responsible for the behavior and compliance of all individuals they invite or host. These rules apply to all renters (long-term or short-term), regardless of whether rental arrangements are made through the office, a property manager, or privately. (This document will be provided to all Homeowners, registered renters, rental agencies, and property managers.)

Rules and Regulations

Homeowner Use of Facilities and Delinquency

a. Delinquency and Access: Homeowners who are delinquent for more than 15 days in any fees, charges, dues, assessments, or other payments owed to the administration will forfeit their Common Area usage rights until their account is current. These Common Area rights include, but are not limited to, access to swimming pools, spas, clubhouses, surf lockers, and fitness facilities.

b. Rental Privileges and Delinquency: Homeowners who rent out their units will lose their rental privileges on the sixteenth (16th) day of delinquency. This means that the renter will not be permitted entry to Club Marena if the owner remains delinquent for more than 15 days.

c. Long-Term Renter Access: Long-term renters will also forfeit all Common Area usage rights on the sixteenth (16th) day of the homeowner’s delinquency. In such instances, the long-term renter’s access to facilities will be suspended until the owner’s account is current.

Check-In / Check-Out Procedures

  • Registration: All Vacation Renters and all Authorized Guests (who are not on the Frequent Guest list) must register and sign in with Security upon arrival. Security will verify identification and authorization for entry. Authorized Users need only register once in Security’s records by the owner; afterward, Authorized Users may enter independently by checking in with Security through ID verification.
  • Identification for Renters: The primary vacation renter named in the rental agreement must present a valid photo ID and a signed copy of the rental agreement to security before entering the property. No vacation renter will be permitted to enter without proper identification and documentation.
  • Check-In Times: For vacation renters, check-in is permitted only between 11:00 a.m. and 5:00 p.m. on the day of arrival, unless special arrangements are made in advance with Security.
  • Check-Out Times: The check-out time for vacation renters is 11:00 a.m. on the day of departure, unless an extension is approved in advance by security. After check-out, vacation renters and their guests must leave the property; they may not remain on-site to continue using the facilities (no surfing, swimming, or lounging in common areas after the check-out time).
  • Parking Pass: Authorized guests and vacation renters must prominently display a security-issued visitor parking pass (or sticker) on their vehicle at all times while on the property. This pass can be acquired at the security gate during registration and must be returned upon departure.
  • Accountability: Homeowners and resident renters are responsible for ensuring their visitors- whether authorized users or authorized guests- adhere to all check-in and check-out procedures. Any issues or violations by guests may result in penalties for the hosting homeowner or resident.

Pools and Jacuzzis

General Pool Rules:

  • Hours: The pool and Jacuzzi are open daily from 7:00 a.m. to 10:00 p.m. Use of these facilities is not allowed outside of these hours.
  • No Lifeguards: Lifeguards are not on duty. All swimmers and spa users participate at their own risk. Please exercise caution and closely supervise children.
  • Proper Attire: Proper swim attire is required in pools and Jacuzzis. Bathing suits or swim trunks must be worn. Wearing inappropriate clothing, such as wetsuits or other surf gear meant for ocean use, is prohibited in the pools or Jacuzzis.
  • Children in Spa: For health and safety reasons, minors under 14 years old are not allowed in any Jacuzzi (hot tub) under any circumstances.
  • Children in Pool: Children under 12 must be accompanied by an adult at all times in pool areas. Additionally, infants and toddlers who are not potty-trained (including those in swim diapers) are not permitted in the pools.
  • Glass Prohibited: Glass containers and other breakable glass objects are prohibited in all pool areas, spa areas, and other common areas for safety reasons.
  • Noise: Please maintain a reasonable noise level. Loud music or any excessive noise that disturbs others is prohibited in the pool and Jacuzzi areas. (Quiet hours from 10 p.m. to 7 a.m. are enforced in all common areas.)
  • After Use: After enjoying a spa, users should turn off the Jacuzzi jets and heater. (Neglecting to do so wastes gas and electricity.)

North Pool and Jacuzzi (Adults Only):

  • The North pool and Jacuzzi are available for use by adult homeowners, long-term renters, and their authorized users (all individuals 16 years or older). This area is designated for the quiet enjoyment of adults.
  • Any other guests must be accompanied by the homeowner or resident renter at the North pool. (In practice, this means only authorized users may use the North pool unaccompanied; all other authorized guests must have their host present.)
  • Vacation renters and children are not allowed to use the North pool or Jacuzzi area. This rule helps to maintain a calm environment for adult residents.

South Pool and Jacuzzi (Family Area):

  • The South pool and Jacuzzi are accessible to Homeowners, Resident Renters, Authorized Users, Authorized Guests, and Vacation Renters. This area serves as the main family-friendly pool space.
  • Children must be supervised. An adult must accompany children under 12 years old at all times in the South pool area. For health and safety reasons, no child in diapers (including swim diapers) or not potty-trained is permitted in the South pool.
  • Minors under 14 are prohibited from entering the South Jacuzzi under any circumstances.
  • All users of the South pool and spa should be considerate of others, share the space, and pick up personal items before leaving.

Pool Area Violations: Violating the pool and Jacuzzi rules will result in a Level One fine starting at USD $50. Repeated violations may lead to higher fines or further action by the administration.

Clubhouses

North Clubhouse (Including Barbecue Area):

  • The North Clubhouse is available for use by adult homeowners, resident renters, and their authorized users only (16 years and older). Guests may use the North Clubhouse only if accompanied by a homeowner or resident renter. This clubhouse is intended for adult-oriented use and small gatherings.
  • Hours: 7:00 a.m. to 10:00 p.m. daily. Residents must conclude their activities by 10 p.m. and ensure that the area is cleaned and secured.
  • Smoking: Smoking or vaping is permitted only in the designated outdoor smoking area by the North Clubhouse. Please utilize ashtrays and dispose of smoking materials properly.
  • Reservations: To book the North Clubhouse for a private event, a Homeowner or Resident Renter must complete and sign a reservation form (available at the HOA office or via email) and submit it to the Administration. For inquiries or reservations, contact the Administration office at clubmarenastatements@gmail.com or (661) 614-1020.

South Clubhouse (Including Barbecue Area):

  • The South Clubhouse is open for use by homeowners, resident renters, authorized users, authorized guests, and vacation renters. This family-friendly clubhouse is accessible to all residents and their guests.
  • Hours: 7:00 a.m. to 10:00 p.m. daily. Like all common areas, Quiet Hours (10 p.m. to 7 a.m.) must be observed.
  • Smoking: Smoking or vaping is permitted only in the designated outdoor area near the South Clubhouse. Please dispose of cigarette butts properly.
  • Reservations: To reserve the South Clubhouse, please complete and sign a reservation form (available from the office or via email), then contact the Administration at clubmarenastatements@gmail.com or (661) 614-1020 in advance.

(When using any Clubhouse, please clean up after use, return furniture to its original placement, and ensure no damage occurs. Hosts are responsible for the conduct of their guests.)

Fitness Center (South Clubhouse Gym)

  • The Fitness Center in the South Clubhouse is designated for use by Homeowners, Resident Renters, and their Authorized Users only. Authorized Guests may access the gym only when accompanied by a Homeowner or Resident and must be 16 years or older. Vacation Renters are not allowed in the fitness center.
  • Hours: 7:00 a.m. to 10:00 p.m. daily. For safety reasons, no one is permitted in the gym outside of these hours.
  • Equipment Use: All users are required to clean and return any equipment to its designated location after use. Do not remove any equipment from the gym, and do not bring in large personal equipment without HOA approval.
  • Noise: Please use personal headphones for any music or audio. Avoid playing loud music on speakers in the gym.
  • Etiquette: Be considerate when using equipment—limit your time on machines if others are waiting and wipe down equipment after use. Proper athletic attire and footwear are required.

Tennis/Pickle-Ball Courts

  • Proper tennis or pickleball attire and etiquette are mandatory on the courts. Shirts must be worn, and only tennis shoes are allowed on the court surface (no black soles or hard shoes that could damage the courts).
  • Priority: Homeowners, resident renters, and their authorized users have priority for court use at all times. If others are waiting, please limit play to one hour for singles and one and a half hours for doubles.
  • Guests and Renters: Vacation Renters and other guests (Authorized Guests) must vacate the court after completing their current game if a Homeowner, Resident Renter, or Authorized User is waiting to play. They should leave the court within 15 minutes of being informed that someone with priority is waiting.
  • Court Reservations: If a court reservation system is in place (please check with Administration), be sure to honor any posted reservations. Unreserved play operates on a first-come, first-served basis, adhering to the priority rule mentioned above.
  • General Courtesy: No food or glass containers are allowed on the courts. Please dispose of trash and close the gates when leaving. Do not retrieve balls from neighboring courts while play is in progress.

Drone Operation

All drone usage on Club Marena property must comply with Mexican law and community safety guidelines:

  • Legal Requirements: According to the Civil Aviation Federal Agency (AFAC) of Mexico, individuals who are not Mexican citizens or legal permanent residents are prohibited from using a drone in Mexico. Furthermore, all drones weighing over 250 grams (0.55 pounds) must be registered with AFAC and operated in compliance with their regulations.
  • On-Site Restrictions: Drone flying is not allowed in a manner that invades the privacy of other residents or guests. Flying drones over private units, balconies, or at low altitudes near people is strictly prohibited.
  • No-Fly Areas: Drones cannot be operated inside buildings, near pools, or directly above crowds. Limit drone activity to open outdoor spaces away from others, and always maintain visual contact with the operator.
  • Safety and Privacy: Do not drop or release any objects from a drone that may harm people or property. The operator is fully responsible for any injury, damage, or disturbance caused by their drone.
  • Violations: Any violation of these drone regulations will incur a fine of USD $100 and may result in the confiscation of the drone until the issue is resolved. Repeated or serious violations could lead to increased fines or a ban on operating drones within the community.

Long-Term Lease Requirements

Owners who lease out their units on a long-term basis (four months or more) must adhere to the following to maintain community safety and compliance:

  • Lease Registration: All long-term lease contracts (rentals longer than four months) must be registered with the VMAC Administration. Owners must provide a copy of the lease agreement to the administration before the tenant moves in.
  • Tenant Screening: Property owners are responsible for vetting their long-term tenants. Owners should conduct due diligence (e.g., background checks) on prospective tenants to ensure they meet generally accepted standards of good conduct and citizenship. When submitting the lease for registration, the owner should provide proof of a background check for the tenant.
  • Access Enforcement: The Administration reserves the right to deny access to Club Marena facilities if a long-term tenant is not properly registered or if the owner fails to provide the necessary documentation.
  • Owner Responsibility: Owners are fully responsible for the actions and behavior of their tenants. Any fines or damages resulting from tenant misconduct will be billed to the owner. The owner must ensure that tenants are aware of all Club Marena rules and regulations (a copy of this document should be provided to all tenants).

General Rules (Community Conduct)

The following general rules apply to all residents and guests to ensure a safe, clean, and pleasant environment for the community. Fines for violations are noted in parentheses, and all listed violations are considered at least Level One infractions (see Violations and Fines section).

  • a. Vacation Renter Inquiries: Vacation Renters should direct all questions, requests, or issues regarding their rental unit (appliances, internet, etc.) to their unit owner or rental agent, not to Club Marena Administration. This ensures that the Administration staff can focus on community needs. (No fine, just a guideline.)
  • b. Noise and Disturbances: Disruptive behavior, loud gatherings, or loud music—whether inside a unit or in any exterior common area—are strictly prohibited. Quiet hours are from 10:00 p.m. to 7:00 a.m. During this time, no noise should be audible to neighbors or other units. (USD $150 fine for violations)
  • c. Contractor Hours: Construction, remodeling, or repair work by contractors is allowed only between 8:00 a.m. and 5:00 p.m., Monday through Friday. Limited quiet work is permitted on Saturdays from 10:00 a.m. to 2:00 p.m. No contractor work (including loud DIY projects) is allowed on Sundays or official U.S. and Mexican holidays. (USD $100 fine for off-hours work)
  • d. Fireworks: Fireworks, firecrackers, poppers, sparklers, and other similar pyrotechnics are prohibited throughout Club Marena property, including the beach. (USD $200 fine)
  • e. Outdoor Music: Music in common areas (beach, pool, lawn, etc.) should be maintained at a volume that does not disturb others. Residents and guests are encouraged to use personal headsets for music. (USD $50 fine for excessive noise)
  • f. Hanging Items: Please refrain from hanging clothing, towels, wetsuits, or any other items on decks, balcony railings, or communal walls. These items can drip water, create an unsightly appearance, and potentially damage the paint or structure. Please utilize designated drying areas for wetsuits and towels (e.g., drying racks or hooks provided near the beach access or surf locker area). A fine of USD $50 will be imposed for items hung in prohibited areas.
  • g. Wet Areas and Elevators: To maintain safety and cleanliness, no wet feet or wet clothing are permitted in elevators or indoor stairwells. If you are coming in from surfing or swimming, please dry off thoroughly with a towel (bring a towel with you to the elevator) and, if available, use the outdoor shower or rinse areas to remove sand and saltwater before entering buildings. (USD $50 fine if water drips in hallways or elevators due to non-compliance)
  • h. Throwing Objects: Nothing may be thrown or dropped from balconies, windows, or any part of a building. This includes no tossing of cigarettes, trash, water, or any objects to the ground or towards other units. (USD $150 fine)
  • i. Surfboards and Equipment Storage: Surfboards, pool floats, beach toys, and other recreational equipment must not be left unattended in common areas (such as lawns, walkways, or the beach access ramp) when not in immediate use. After using these items, residents and guests should store them in surf lockers or within their units. Any equipment or personal items left in non-designated common areas will be collected by staff and placed in the community Lost and Found. Owners may retrieve their belongings from Lost and Found by contacting Security or the Administration office. Repeated violations or items left long-term may result in a fine of USD $50 for repeat offenses of leaving items out.
  • j. Barbecue Use: Only propane-fueled barbecues, grills, or fire pits are permitted in Club Marena common areas or on balconies. Charcoal lighter fluid is prohibited due to its odor and potential for flare-ups. When grilling, please minimize excessive smoke to consider neighbors. Burning wood (except for small wood chips in an enclosed smoker box) is strictly prohibited. A fine of USD $500 will be imposed for improper grill use or open fires.
  • k. Smoking Areas: Smoking or vaping is only permitted on the ground-level patio of each Villa on the ocean-facing side, preferably on the walkway side away from the buildings. This measure helps to prevent smoke from entering other units. Always dispose of smoking materials responsibly. (USD $50 fine for smoking in non-designated areas)
  • l. Lobby and Hallways: Lobby areas and indoor hallways must remain free of personal items. Please do not leave shoes, toys, baby strollers, bicycles, surf equipment, or other personal belongings in these common areas. Such items can pose hazards and create clutter. (USD $50 fine; items may be removed by staff if left in lobbies or hallways)

Beach and Surf Access Guidelines

To preserve the quality of the surf break and ensure only authorized individuals use Club Marena’s beach access, the following guidelines are in place for surfing and beach activities:

  • Authorized Beach Access: Only Club Marena residents (homeowners, resident renters, and their registered authorized users) and their guests may use the beach staircase and surfboard ramp for ocean access. No outside surfers or public members may enter or exit through Club Marena’s beach access without permission. Security will monitor the beach gate and ramp area to ensure compliance.
  • Security Verification: All individuals using the beach access or entering from the ocean via Club Marena property should be prepared to identify themselves to Security upon request. Security guards may politely ask for your unit number or host to verify that you are a Homeowner, Renter, Authorized User, or an accompanied guest. Those who cannot be confirmed as authorized users of the property will be denied further access and treated as trespassers if they attempt to enter.
  • Homeowner Cooperation: Homeowners are encouraged to register any family members who surf as Authorized Users or to add them to the frequent guest list with Security. By doing this, Security can easily identify authorized family surfers and prevent unnecessary questions or confusion. Owners should also be mindful of the number of surfing guests they invite at one time – please use common sense and courtesy to avoid overcrowding the break with too many people.
  • Use of Surf Amenities: Near the beach access, an outdoor shower and rinse-off station are available. Surfers must remove sand and saltwater at this station before using the pools, parking areas or entering the buildings.
  • Respect for Community: Whether on the beach or in the surf, all individuals should demonstrate good sense and courtesy. Avoid crowding other surfers, always respect the right-of-way on the waves, and be friendly to fellow Club Marena surfers. The surf break adjacent to Club Marena is a cherished resource – treat it and one another with respect.
  • Trespassing Warning: For safety and security, anyone attempting to enter or exit the beach through Club Marena who is not an authorized resident or guest will be stopped by Security. Unidentified individuals or those not accompanied by a resident will be escorted off the property and may face trespassing charges. Residents should not encourage or allow unauthorized surfers to sneak in through our property.

Violations, Enforcement, and Fines

Club Marena strictly enforces all rules and regulations mentioned above. All residents, authorized users, and guests must follow the community rules with common sense and courtesy. The security team and the HOA have the authority to issue warnings or impose fines for violations deemed appropriate.

  • General Enforcement: Any activity on Club Marena property that is illegal under local law or violates these community rules may lead to immediate removal from the premises and/or involvement of law enforcement if necessary. Security guards and HOA management possess the authority to enforce rules consistently and fairly. Residents are expected to comply with the instructions of security personnel in upholding these rules. Any individual who verbally or physically threatens a homeowner, security guard, or VMAC employee will face serious repercussions (immediate fines, potential eviction, and possible detention by local police).
  • Trespassing: Club Marena is private property. Any individual entering or exiting the beach through Club Marena who is not a homeowner, resident, renter, authorized user, or authorized guest is trespassing on private property and will be dealt with accordingly. Security works closely with the Primo Tapia Police Department, and trespassers or individuals committing offenses may be referred to local authorities.
  • Fine Levels: The HOA employs a tiered fine system for rule violations, based on the severity and frequency of the infractions:
    • Level One: Minor infractions of the rules (e.g., first-time noise complaints, minor pool violations, and leaving items in common areas). Fines range from USD $50 to $200. Repeated minor violations may result in escalating fines within this range.
    • Level Two: Major infractions, such as gross disrespect toward any resident or staff members, or causing damage to Club Marena property (e.g., defacing property, damaging pool furniture), will incur fines. Fines for major infractions range from USD $201 to $500, following an administrative review.
    • Level Three: Severe infractions include any willful threats or physical harm to others, substantial property damage, or serious violations of law or HOA bylaws. Fines for severe infractions start at USD $501 and can reach up to $1,575 (maximum, after administrative review). Such violations may also lead to suspension of privileges or legal action.
  • Owner Responsibility for Fines: If a vacation renter or guest of a unit violates the rules and incurs a fine, the homeowner of that unit is ultimately responsible for paying the fine if the renter or guest fails to pay. Multiple violations by renters or guests of the same unit (three or more within a calendar year) will trigger an administrative review and may result in the suspension of that unit’s rental privileges, regardless of whether the fines have been paid.
  • Amendments: The VMAC Board of Directors will periodically review these Rules, Regulations, and Code of Conduct and may adopt modifications or new rules as necessary to address community concerns. Homeowners will be notified of any changes in writing. Each homeowner (and their renters) is responsible for staying informed about and complying with the current rules.

By following these rules and guidelines, we can all enjoy a safe, respectful, and pleasant environment at Club Marena. Thank you for your cooperation and for being a considerate member of our community.
